Privacy Policy

ProAct Traders LLC (“ProAct Traders,” “we,” “us”) has taught traders since 2004. We are committed to protecting our customers' personal and financial information. This policy explains what personal information we collect, how we use and share it, how long we keep it, and the choices and rights you have.

It covers proacttraders.com and everything that links to this policy: our courses, memberships, charts and indicators, live rooms, emails and customer support (together, our “services”). Your use of our services is also governed by our Terms of Service.

The short version:

  • We don't sell your personal information, and we never see or keep your full credit card number.
  • We collect what we need to sell you our products, give you access, support you and improve our site.
  • We share it only as this policy describes: mostly with the companies that run parts of our business for us, and with TradingView so you can use our indicators.
  • You can unsubscribe from marketing emails at any time, decline analytics cookies, and ask us to show you, correct or delete your information.

Information we collect

Information you give us

  • Contact details: your name and email address, for example when you start a free trial, join our newsletter, contact us or buy something.
  • Purchase details: what you bought, what you paid and when, and your billing address and phone number if the checkout asks for them. Your card details go straight to the payment processors our checkout provider uses; we never receive or store your full card number.
  • Access details: your TradingView username, so we can give you access to our invite-only indicators, and your account details for our members' area (the Academy).
  • What you send us: messages, support requests, survey answers, testimonials and reviews.
  • What you share in live rooms and other shared spaces: your name or username, chat messages and questions, and your voice or image if you choose to speak or turn on your camera.

Information collected automatically

  • Device and usage information: your IP address, browser and device type, the pages you view, the buttons and links you click, the page that sent you to us, and the date and time of your visit. We may also work out your approximate location (such as your country or city) from your IP address.
  • Cookies and similar technologies: see “Analytics and cookies” below.
  • Email activity: our emails may tell us whether you opened them and which links you clicked.

Information from others

  • Our checkout provider and payment processors: your order and payment status (never your full card number).
  • Partners who refer you to us: the fact that you came through them, so they can be credited.
  • Social media platforms: what you share with us, or make public, when you interact with our pages there.

We don't ask for sensitive information such as government ID numbers, health information or your precise location. Please don't send it to us.

How we use your information

  • To provide our services: to process orders and subscriptions; give you access to our courses, charts, indicators and live rooms; and credit what you've already paid toward upgrades such as Fast Track.
  • To communicate with you: receipts, access details, account and service notices, answers to your questions, and changes to our terms or this policy.
  • To market to you: our newsletter and news about our products and offers. You can unsubscribe at any time.
  • To understand and improve our site and services: for example, which pages and offers work and what needs fixing.
  • To keep our services secure: to prevent fraud, abuse, account sharing and unauthorized copying of our materials.
  • To handle payment disputes and chargebacks: we may give the payment processor or your card issuer records of your purchase, your agreement to our terms, and your access to and use of our products.
  • To comply with the law and enforce our terms: for example, to keep tax and accounting records, answer lawful requests, and protect our rights and the rights and safety of others.
  • For other purposes we tell you about when we collect the information, or with your consent.

We may also combine or de-identify information so it no longer identifies you, and use it for any purpose. We keep de-identified information in that form and don't try to re-identify it.

Analytics and cookies

We use PostHog to understand how visitors use this site, such as which pages are viewed and which buttons are clicked, so we can improve it. On your first visit, a banner asks whether you accept cookies. If you accept, PostHog stores cookies so it can recognize your browser on later visits. If you decline or don't choose, we count your visit without cookies, using an anonymous code that changes every day. If you decline, PostHog saves only that choice in your browser, so the banner doesn't ask again. As with any website visit, PostHog receives basic technical details such as your IP address and browser type. We never send your name, email or payment details to PostHog, and we don't record your screen. To change your choice, clear this site's data in your browser and the banner will appear again.

Other services on our pages

  • Fonts: our pages load their font from Google Fonts, so Google receives your IP address and browser details when a page loads.
  • Videos: videos play through YouTube (in its privacy-enhanced mode) or Vimeo (with its “do not track” setting on). When you play a video, YouTube or Vimeo may collect information under its own privacy policy.
  • Checkout: our checkout pages are run by our checkout provider, which may use its own cookies to process your order and prevent fraud.
  • Referral links: some of our links, such as our TradingView link, are referral links. If you use one, that company may use cookies to credit us, and we may earn a commission. In the same way, partners who send you to us may be credited through a code in the link or a cookie.

The companies named above may collect information about your visit under their own privacy policies, and some of them, such as Google, may connect it with your activity on other websites. Apart from them, we don't let other companies collect information on our site to follow you across websites. Our site doesn't use advertising pixels or advertising cookies. If that changes, we'll update this policy first.

Do Not Track and Global Privacy Control

Our site doesn't respond to browser “Do Not Track” signals, because there's no common standard for them; you can decline cookies with our banner instead. If your browser sends a Global Privacy Control signal, we treat it as a request to opt out of the sale or sharing of your personal information. We don't sell or share personal information, so nothing else changes.

How we share your information

We share personal information only as described here:

  • Service providers: companies that run parts of our business for us, such as checkout and payment processing, email and customer records, our members' area, website hosting and analytics. They get what they need to do that work.
  • TradingView: to give you access to our invite-only indicators, we add your TradingView username to the indicator's access list on TradingView.
  • Payment disputes: your card issuer or the payment processor, if you dispute a charge.
  • Professional advisers: our lawyers, accountants and insurers, when needed.
  • Legal and safety reasons: to comply with the law or a lawful request, to enforce our terms, and to protect the rights, property or safety of ProAct Traders, our customers or others.
  • Business transfers: if we're involved in a merger, acquisition, financing, reorganization, bankruptcy or sale of all or part of our business, personal information may be transferred as part of that deal.
  • With your consent or at your direction: for example, when you agree to let us publish your testimonial.

We don't sell your personal information. We don't share it for targeted (cross-context behavioral) advertising, and we don't give it to other companies for their own marketing. We never sell or share your phone number or text-message consent with anyone for their marketing.

Emails and text messages

Every marketing email we send has an unsubscribe link. Unsubscribing stops marketing emails; we'll still send messages about your purchases, your access and your account. If we send you marketing text messages, it will only be with your permission, and you can reply STOP at any time to stop them.

How long we keep your information

We keep personal information only as long as we need it for the purposes in this policy, including legal, tax, accounting and dispute needs. In practice:

  • Purchase and payment records: as long as tax and accounting laws require, and long enough to handle refunds, chargebacks and disputes.
  • Account and access information: while you have access, and for a reasonable time afterward in case you come back or have questions.
  • Email subscriptions: until you unsubscribe. After that, we keep your email address on a do-not-email list so we don't email you again by mistake.
  • Messages and support requests: as long as we need them to help you and to keep a record of what was agreed.
  • Analytics: for the period set in our analytics provider's settings.

When we no longer need information, we delete it or de-identify it.

How we protect your information

We restrict access to your personal information to the people who need it to provide our products and services to you, and we use physical, electronic and procedural safeguards to protect it. Card payments are handled by our checkout provider's payment processors, so we never see or store your full card number. No website, email or storage system is 100% secure, so we can't guarantee absolute security. Please keep your password private and don't share your account. If a data breach affects your personal information, we'll notify you as the law requires.

Your choices

  • Marketing emails: use the unsubscribe link in any of our emails, or email us.
  • Cookies: accept or decline in our banner; to change your choice, clear this site's data in your browser. You can also block cookies in your browser settings, but some features, such as checkout, may need them to work.
  • Information you give us: you can choose not to give it, but then we may not be able to provide some services. For example, we can't give you indicator access without your TradingView username.

Your privacy rights

Wherever you live, you can ask us to:

  • tell you what personal information we have about you and give you a copy;
  • correct information that's wrong; and
  • delete your personal information.

We'll do so unless the law requires or allows us to keep it, for example purchase records we must keep for tax purposes or to handle a dispute.

Depending on where you live, including California, Texas, Virginia, Colorado, Connecticut and other U.S. states, the European Economic Area, the United Kingdom and Switzerland, you may also have the right to:

  • get your information in a portable format;
  • opt out of the sale or sharing of your personal information, targeted advertising and certain profiling (we don't do any of these);
  • limit the use of sensitive personal information (we don't use it to infer anything about you);
  • withdraw your consent at any time, where we rely on it;
  • not be treated differently for using your privacy rights; and
  • appeal our decision on your request.

How to make a request

Email support@proacttraders.com with “Privacy request” in the subject line and tell us what you'd like us to do. To protect you, we'll confirm your identity before acting, usually by matching your request to the email address we have for you; we may also ask for a detail such as a recent order. You can use an authorized agent: we'll need your written permission for them to act for you, and we may confirm the request with you directly. We'll respond within 45 days. If we need more time (up to another 45 days, where the law allows), we'll tell you why.

If we decline your request, you can appeal by replying to our decision with “Appeal” in the subject line. We'll answer your appeal within 45 days. If you're not satisfied with the result, you can contact your state attorney general.

Summary for U.S. state privacy laws

In the past 12 months we have collected these categories of personal information: identifiers (such as your name, email address, IP address and usernames); customer records (such as your billing address and phone number); commercial information (what you bought); internet activity (such as pages viewed and links clicked); approximate location; and audio or visual information (only if you speak or appear on camera in a live session). We collected it from you, your devices, our service providers and our partners, for the purposes in “How we use your information.” We disclosed these categories to our service providers for business purposes, and identifiers to TradingView to give you indicator access. We have not sold or shared personal information, and we don't use sensitive personal information to infer characteristics about you.

California: California residents can also ask which personal information we shared with third parties for their own direct marketing in the past year. We don't share personal information for that purpose. Nevada: we don't sell covered information as Nevada law defines it.

Visitors from the EEA, the UK and Switzerland

If you're in the European Economic Area, the United Kingdom or Switzerland, ProAct Traders LLC is the controller of your personal information. We process it on these legal bases:

  • Contract: to provide what you bought or asked for.
  • Legitimate interests: to run, secure and improve our business, handle disputes, and tell you about our products, balanced against your rights.
  • Consent: for analytics cookies and, where the law requires it, marketing emails. You can withdraw your consent at any time.
  • Legal obligation: to keep tax and accounting records and to respond to lawful requests.

You also have the right to restrict or object to our processing (including for direct marketing) and to complain to your local data protection authority.

We're based in the United States, and our service providers may process your information in the United States and other countries whose data protection laws may differ from yours. Where the law requires, we put safeguards in place for these transfers, such as data-processing terms with our providers.

Children

Our services are for adults 18 and older. We don't knowingly collect personal information from anyone under 18, and we don't sell or share the personal information of anyone under 16. If you believe a child has given us personal information, contact us and we'll delete it.

Live rooms, testimonials and shared spaces

In live rooms, chats and other shared spaces, other people can see what you post and your name or username. Live sessions may be recorded and shared with members. Please don't share private information there.

If you send us a testimonial or review, we may publish it with your name or initials, on our site and in our marketing, with your permission. To have it removed, email us.

Other websites

Our site links to other websites and services, such as TradingView, YouTube, Facebook and X. Their own privacy policies apply when you use them, and we're not responsible for their practices. Our indicators run on TradingView, and TradingView's own terms and privacy policy cover your TradingView account.

Changes to this policy

We may update this policy from time to time. We'll post the new version on this page and change the date at the top. If we make a material change, we'll tell you before it takes effect, for example by email or with a notice on our site.
